Civil Litigation Matters
Partition Lawsuits
Partition lawsuits occur when two or more land owners own real property together and cannot agree on the management or sale or use of the property. In this case, a property owner that wants to sell the property has a legal right to do that and ask the court for a partition.
Deadlock Lawsuits
These suits are similar to a partition suit but occur when the real estate in dispute is held in a land trust with beneficiaries that control the management of the real estate. Similar to a partition, the beneficiaries of the land trust or other trust, cannot agree on the management or best use of the property or the sale of the property. A plaintiff may ask the court under these circumstances, to force the sale or direct some mandatory action.
Evictions Lawsuits
Eviction suits arise when a tenant’s lease has ended or when a tenant’s lease has been terminated for nonpayment of rent or some other legal basis, and the tenant refuses to deliver possession to the landlord or pay rent. Eviction suits can be more complicated if there are unknown occupants living at the property that the landlord did not authorize. Under these circumstances, care must be taken to join the unknown occupants in the suit so any order of possession is enforceable against unknown occupants.
